Terms and Conditions of Sales Effective: June2024
GENERAL *Product warranty is not transferrable and only the original purchaser of the products can make a claim under its warranty. 1. Upon acceptance of these terms, a binding contract is entered into between the customer and Diamond Blinds and Shutters not withstanding Diamond Blinds right of non-acceptance due to errors and omissions. 2. Quotations provided by Diamond Blinds valid for 30 days and may be subject to change after that time. Accepted orders are subject to checking at Diamond Blinds office where Diamond Blinds the right of non-acceptance. 3. Completion date is an estimate only and subject to material availability. No responsibility will be accepted for delays as stated in clause 20. 4. Customer to make access to the works available between 7.00am to 4.00pm Monday to Friday or as otherwise agreed. 5. Customer accepts that any powder coat colours and brand stated on this quote are as per the customers selection and that Diamond Blinds no responsibility for shade variations. 6. Diamond Blinds accepts no responsibility for material variations such as colour, grain, rippling, shrinkage or changes in length and Diamond Blinds not be liable in any way for loss or damage suffered consequently thereof. 7. Whilst every attempt will be made by Diamond Blinds ensure that the products sold and delivered match samples or products on display in showrooms, any minor or immaterial variation or change in colour or grain between the sample and the goods delivered shall not entitle the customer to reject the goods nor to claim any compensation for such variation or change. 8. Diamond Blinds to achieve the highest standard possible in the manufacture and installation of products which have been purchased and all work will be carried out as directed by Diamond Blinds specific instructions are written on this agreement, or actual written specifications are given to Diamond Blinds the customer at point of sale. 9. Customer acknowledges that Diamond Blinds are not qualified colour consultants or interior decorators – any suggestions or recommendations are their opinions only and the customer takes responsibility for the choice of materials or products ordered. 10. The acceptable standard for imperfections on the final job is – if it is visible with the naked eye, in natural daylight at a distance of 1.2 metres, it is not acceptable. If it is not visible with the naked eye, in natural daylight, at a distance of 1.2 metres it is acceptable. Terms of payment 11. Deposit A 50% deposit is required upon acceptance of the quote and placement of the order. This deposit is non-refundable if you cancel the order after work has commenced on your products. 12. Final Payment The final 50% payment is due on the day of completion of the installation. Payment must be made in full before the installers leave the premises. We accept cash, credit card, debit card, or EFTPOS. 13. Late Payment Fees A late fee of 2% per month will be applied to any outstanding balance after 14 days from the due date. We reserve the right to take legal action to recover any outstanding debts, and you will be liable for all associated costs, including legal fees. 14. Retention of Title You acknowledge that the goods and services we supply remain our property until you pay for them in full. If you default on any terms of this agreement, including payment, we have the right to repossess the goods without notice. You authorise us or our representatives to enter the premises where the goods are located to reclaim them. We will not be responsible for any costs, losses, or damages resulting from repossessing the goods. 15. Progress Payments for Delayed Delivery/Installation If you are not ready to receive or have the goods installed after six weeks from the manufacture date due to reasons on your end, you may be required to pay a progress payment of up to the total value of the purchase price or as otherwise agreed upon in writing. 16. Customer Refusal of Acceptance or Installation If we advise you that your ordered products are ready for installation and you refuse to accept them or make arrangements for installation within a reasonable timeframe, or if we cannot contact you after reasonable efforts, the remaining balance will become due immediately. We can treat the remaining amount as a judgment debt enforceable without further action. 17. Service of Notices You agree that service of any notices or Court documents may be affected by forwarding them by pre-paid post or facsimile to your last known address or fax number. 18. The customer agrees not to hold Diamond Blinds responsible for any delays with supply or installation and agrees not to demand any compensation, whether monetary or otherwise. The customer also agrees not to withhold payment if, for any reason, a minor part of a customer’s order is delayed. 19. The customer agrees that service of any notices or Court documents may be affected by forwarding same by pre-paid post or facsimile to the last known address or facsimile number of the customer. 20. Force Majeure Diamond Blinds not be liable for any failure or delay to supply, deliver, or install the products where such failure or delay is wholly or partly due to any cause or circumstance whatsoever outside the reasonable control of Diamond Blinds. This may include, but is not limited to, natural disasters, acts of war or terrorism, labour disputes, or material shortages. Product Installation 21. Customer Access Customers are required to provide suitable access for all installation inside and outside the house before the commencement of the work. This includes removing any obstructions that could interfere with the installation or valuables that could be damaged. If a Diamond Blinds technician encounters any unforeseen difficulty with access or installation due to a customer lack of preparation, the customer agrees to pay for any additional costs that may arise. 22. Asbestos Customers are responsible for advising Diamond Blinds of the presence of any asbestos at the installation address, as disturbing asbestos during installation can be hazardous. 23. Existing Window Treatments Customers are responsible for removing any existing window treatments unless other arrangements are made with the Diamond Blinds Representative at the point of sale. 24. Window Squareness Diamond Blinds products are manufactured to be square. However, some exceptions may exist. Diamond Blinds cannot accept responsibility for windows that are out of square, as this is a building issue, not a product issue. 25. Damage During Installation Diamond Blinds will not be responsible for any damage that may occur at or after the installation of a product or accessory that requires fixing into materials, including (but not limited to) tiles, carpet, timber flooring, or laminated benchtops. It is important to understand the potential risks of drilling or screwing into these surfaces before installation. 26. Damage to Premises or Interruptions to Services While Diamond Blinds takes great care during installation, the company will not be responsible for any damage to premises or interruption to services where such damage or interruption is a result of circumstances beyond Diamond Blinds control.This may include unforeseen structural issues or encountering pre-existing wiring or plumbing during installation. 27. Corded Blinds and Child Safety Please note that all blinds installed by Diamond Blinds will comply with Australian Child Safety Laws. Guarantee and Warranty 28. Product Suitability and New Condition Diamond Blinds warrants that all products are fit for their intended purpose and are new unless otherwise stated in the contract. 29. Warranty on Defects Diamond Blinds guarantees that all our products will be free from defects in components and manufacturing at the time of installation. This guarantee only becomes effective after full payment has been received. Diamond Blinds will use its best efforts to pass on to the customer the benefit of any guarantees or warranties received from manufacturers for products or parts not manufactured by Diamond Blinds. Domestic Use Warranty For domestic use, all supplied goods are guaranteed against faulty materials and workmanship. Diamond Blinds will, at its discretion, repair or replace products or parts thereof that prove faulty. This warranty does not cover damage caused by accidents, misuse, or colour change resulting from solar or other heat sources. If a Diamond Blinds technician determines that a reported defect is not due to faulty workmanship or material, a call-out fee may be charged. 31. Compliance with Laws and Regulations Diamond Blinds warrants that all work will be carried out in accordance with all relevant laws and legal requirements.
